Competition Commission of India Dismisses InstaAstro's Petition Against Astrotalk
The Competition Commission of India (CCI) has dismissed a petition filed by InstaAstro, alleging that online astrology platform Astrotalk is abusing its market dominance. InstaAstro claimed that Astrotalk was engaging in practices that harm competition.
InstaAstro alleged that Astrotalk is poaching its consultants by offering them higher monthly remuneration, up to INR 5 Lakh. The company also claimed that Astrotalk signed restrictive agreements with the poached consultants, preventing them from working with InstaAstro or other competitors.
However, the CCI found that InstaAstro failed to provide concrete evidence to support its claims. The commission noted that multiple established competitors already exist in the market, which imposes competitive restrictions on Astrotalk.
Astrotalk's CEO, Puneet Gupta, had made statements on social media platforms claiming to occupy 80% of the market share. The CCI, however, pointed out that media statements cannot solely establish dominance.
CCI blatantly quashed the complaint and ruled that there is no prima facie case against Astrotalk for violating Section 3 and Section 4 of the Competition Act. In addition, the commission also rejected InstaAstro's request for penalties and compensation, stating that there is no prior basis for such relief.
This decision marks a significant victory for Astrotalk, which has faced several legal challenges. Another competitor, Astroyogi, had sued Astrotalk for unauthorized use of its trademark and branding elements.
The premium astrology platform Astrotalk expressed appreciation for the CCI's decision, stating that it will continue to promote fair competition in the online astrology market. "We are pleased with the CCI's decision and reaffirm our commitment to fair competition," said a spokesperson for Astrotalk.
